Maria specializes in building intellectual property management systems. As a registered Russian patent attorney in trademarks, she has extensive experience in successfully registering trademarks and managing large-scale trademark portfolios.

She represents clients before the Chamber for Patent Disputes of Rospatent and Russian courts and provides legal support for intellectual property transactions, including conducting comprehensive legal due diligence of companies' IP assets.

Maria Moishe is a member of the Intellectual Property Council of the Chamber of Commerce and Industry of the Russian Federation, actively participates in conferences and webinars on intellectual property and information technology issues, and is the author of publications in this field.

Maria ’s expertise includes:

Supporting the registration and protection of intellectual property rights, including trademarks, industrial designs, software, and other IP assets.
Developing and implementing intellectual property management systems within companies, including drafting IP policies and employee agreements.
Structuring and formalizing transactions related to the creation, use, and disposal of intellectual property rights.

Selected Experience

TRADEMARK REGISTRATION AND IP MANAGEMENT

Maria advised:

foreign and Russian clients in successfully registering several hundred trademarks, including overcoming registration refusals, including before the Chamber for Patent Disputes;

one of the world's largest online banks in managing a large portfolio of intellectual property objects;

a major Russian bank in developing and implementing a policy on service works, including preparation of employee agreements and resolution of author's remuneration issues;

a foreign company, the rights holder of means of individualisation for the world motorsport championship, on protecting trademark rights in Russia and preventing the distribution of counterfeit products.

IP DISPUTE RESOLUTION

Maria advised:

a foreign pharmaceutical company in a patent dispute over protection of rights to an invention for a method of producing a medicinal product and recovery of compensation of around RUB 1 billion, concluding the case with a settlement agreement on favourable terms for the client;

one of the world's largest online banks in a precedent-setting court dispute with a voice actor over issues of using his voice in neural network-based speech synthesis and protection of business reputation;

Russia's largest aviation holding in a dispute over recovery of licence fees under an agreement related to bringing military, special, and dual-use products into civil circulation;

a publishing house in a plagiarism dispute, settled with a favourable settlement agreement for the client;

a financial organisation in pre-court settlement of a dispute over unlawful use of a trade name;

one of Russia's largest IT companies in successfully challenging before the Chamber for Patent Disputes of Rospatent a decision refusing trademark registration.

IP TRANSACTIONS AND CONSULTING

Maria advised:

conducting more than 50 legal due diligence reviews of IT companies to determine ownership of rights to intellectual activity results;

one of Kazakhstan's largest commercial banks on a transaction to acquire rights to software, including negotiations with the foreign rights holder;

one of the largest diversified healthcare corporations on localising production in Russia and structuring transactions with foreign group companies regarding use of IP assets;

a Russian scientific and production company in developing and supporting the conclusion of a pledge agreement for exclusive rights to intellectual property objects to secure obligations to an investment fund.
