Representation of a major investment company on recording a claim in the register following cancellation of recording and referral of the dispute by the court of appeal to be reconsidered. As a result, the principal’s claim worth more than RUB 1 billion was recorded in the register.
Recognition of the debtor’s transactions on alienation of the rights to claim with the market value exceeding RUB 900 million as invalid. The dispute was complicated due to the fact that the assets had been withdrawn via a series of transactions for the benefit of formally non-affiliated persons. The combination of general and special grounds for challenging the transactions helped successfully return the asset to the debtor’s bankruptcy assets.
Challenging of the transaction that served as grounds for recording the lender’s claim worth more than RUB 500 million in the register (non-bankruptcy challenging approach).
Representation of a leading Asian food supplier in Russia in a dispute on recognising a transaction with such supplier as invalid. The purpose was to protect the Principal’s transaction on the purchase of a production complex completed 7 months before the seller’s bankruptcy from being challenged. The purpose was to protect the acquisition of the lender’s major asset by the Principal (the former general director of the insolvent party) from being challenged. The transaction defence was successful with the asset retained by the Principal.
