In the United Kingdom, the number of anti-suit injunction (ASI) cases involving Russian persons has increased five times over the last three years. 74 percent of cases heard over the last five years were triggered by the sanctions against Russia.
After 2022, the percentage of ASI cases involving Russia increased from 14 percent to 47 percent. A third of the cases heard included references to the "Lugovoi Law," whereunder Russian persons are allowed to demand that any proceedings involving Russian persons be held in Russian courts only.
This is a "jurisdictional warfare," noted Anton Alifanov, VERBA LEGAL's Counsel. Russian sanctioned persons who are unable to seek resolution of disputes in Western arbitration courts are forced to resort to litigation proceedings in Russian courts, while their western counterparties try to preserve the jurisdiction of an arbitration court agreed upon in the arbitration clause.
