VERBA LEGAL lawyers secured reversal of the court order on issue of a writ for enforcement of the arbitral tribunal’s award

In 2024, ICAC at the RF CCI made an award on a dispute between the participants of a holding company registered under the Hong Kong law. The claims had arisen out of an alleged breach of the shareholders’ agreement governed by the English law. The arbitral tribunal partially upheld the claims.

The VERBA LEGAL team got involved in the project at the stage of the writ issue by the state arbitration court and, having reviewed the arbitral award and the arbitration materials, came to a conclusion that a basis existed for the writ to be denied.

The first instance court had handled the matter as a mere formality and granted the opponent’s claims.

Subsequently, the VERBA LEGAL lawyers managed to obtain suspension of the appealed ruling enforcement, having convinced the cassation instance that the lower court had breached the legal procedure and failed to check the arbitral award for compliance with the Russian public order. As a result, the dispute was remanded for further consideration by a different first-instance tribunal.
